And now that this is may be overturned by the Supreme Court, Bush tried to move him into the regular court system so that there is no challenge to his "war powers."

The U.S. Court of Appeals for the 4th Circuit (the most conservative in the nation) refused to allow prosecutors to take custody of Padilla from the military and rebuked the Bush administration for its handling of the case. The Bush administration took strong issue with the Richmond-based court's decision and appealed it to the Supreme Court.
